Auction Terms and Conditions

  1. Introduction
    1. The following definitions apply to this Auction Agreement:
    2. Auction
      means an electronic time-critical auction on which Registered Users may Bid;
      means Fivefootsix;
      means a table tennis bat designed by an artist and to be sold to raise money for charity;
      means an offer to acquire a Bat which is, once accepted, legally binding;
      means PayPal (Europe) S.à r. l. et Cie, S.C.A trading as “Braintree”;
      End Date
      means 30 November 2015 at 12:00;
      Fivefootsix Limited;
      means an invitation by the Auctioneer for an offer that displays no intention by the inviting party to be contractually bound at that moment;
      Maximum Bid
      means the highest Bid that the Registered User is willing to be automatically made on their behalf;
      means the sending of money equal to a Winning Bid;
      Registered User
      means any individual or legal entity that signs up to the Terms;
      Start Date
      means 5 November 2015 at 12:00;
      means the terms of this Auction Agreement together with the privacy policy;
      Winning Bid
      means the highest Bid made at the End Date or in accordance with clause 2.5; and
    3. The Auction will end at the End Date. After this time no further Bids can be made.
    4. By using the Website, Users agree to be bound by the Terms.
  2. Bids
    1. The Auction has been created by the Auctioneer who is issuing an Invitation to Registered Users.
    2. When a Bid is made, both the Registered User and Auctioneer accept that:
      1. this may be a Winning Bid;
      2. a commitment to making a Payment has been accepted;
      3. they intend to be bound by the arrangement;
      4. if the Registered User is outbid and has specified a Maximum Bid, they will automatically be deemed to have made a new Bid £1 higher than the current highest Bid unless the current highest bid is greater than the Maximum Bid;
      5. a Bid or Maximum Bid may be increased at any time prior to the End Date by a Registered User; and
      6. the Registered User may choose to make their Bid anonymously.
    3. The Winning Bid will be the highest Bid and must meet any other conditions specified in this Auction Agreement or the Terms.
    4. At the end of the Auction, the Registered User that has the Winning Bid will make a Payment in consideration for the Bat and in accordance with clause 2.7.
    5. If the highest Bid is removed for any reason after the end of the Auction, the next highest Bid will automatically become the Winning Bid. Should this happen the Registered User of the next highest Bid will be given the option to accept or reject having the Winning Bid. If rejected, the Registered User with the next highest Bid will be given the option until a Winning Bid has been accepted.
    6. A Registered User may not retract a Bid except for the limited circumstances under applicable law or in connection with Clause 3 below.
    7. The Registered User accepts that they will have to make a Payment for any shipping costs (which can be found at in addition to the Winning Bid.
  3. Errors
    1. Fivefootsix shall have no liability where a Bid fails to be received, is delayed or where the Bid is made in error for whatever reason. Fivefootsix is under no obligation to correct erroneous Bids or to resubmit Bids which were lost in transmission or otherwise registered on the Website.
    2. Whilst the Registered User takes full responsibility for any use of their account, in the case of an obvious error Fivefootsix has the right to reject any Bid.
    3. As soon as the Registered User becomes aware of an error, they should email Fivefootsix will investigate the error to determine in its discretion whether the Bid is invalid. Fivefootsix will then communicate its decision to the Registered User.
  4. Payments
    1. All Payments made via the Website will be processed through Braintree whose full terms and conditions can be found at
    2. Once a Registered User has made a Payment they will receive a confirmation email either from Fivefootsix or Braintree.
    3. Given the charitable nature of the auction we do not supply refunds.
  5. General
    1. With regard to any Auction Fivefootsix reserves the right to:
      1. change the Start Date;
      2. remove it from the Website; or
      3. change the End Date,
      4. at any time and at its absolute discretion.
    2. If an Auction is changed in any way in accordance with Clause 5.1 and subsequently re-activated, all previous Bids will lapse.
    3. The use and processing of any personal data shall be in accordance with the privacy policy at
    4. Any disputes between Registered Users shall be dealt with by Fivefootsix.
    5. If any part of this Auction Agreement is found to be unenforceable as a matter of law, all other parts will not be affected and shall remain in force.
    6. This Auction Agreement will be governed by the laws of England and Wales and will be dealt with exclusively by the English courts.

    *Due to the delicate nature of the artworks, extra care will be taken to ensure it gets to you safely and securely. Because of this, the total shipping and handling time may take up to 20 days.

The Data Controller processes the Data of Users in a proper manner and shall take appropriate security measures to prevent unauthorised access, disclosure, modification, or unauthorised destruction of the Data.The Data processing is carried out using computers and/or IT enabled tools, following organisational procedures and modes strictly related to the purposes indicated. In addition to the Data Controller, in some cases, the Data may be accessible to certain types of persons in charge, involved with the operation of the site (administration, sales, marketing, legal, system administration) or external parties (such as third party technical service providers, mail carriers, hosting providers, IT companies, communications agencies) appointed, if necessary, as Data Processors by the Owner. The updated list of these parties may be requested from the Data Controller at any time.

Retention time

The Data is kept for the time necessary to provide the service requested by the User, or stated by the purposes outlined in this document, and the User can always request that the Data Controller suspend or remove the data.
